Full Contest Terms and Conditions |
| - Information on how to enter and prizes form part of the Terms and Conditions of entry. Participation in the Marillion Whatever is Wrong With You Video Contest implies acceptance of the Terms and Conditions of entry. |
| - To enter the Marillion Whatever is Wrong With You Video Contest, participants must upload a qualifying video (as detailed in these Terms and Conditions) no later than 0:01 on 1 December 2008 local (London) time |
| - The qualifying video with the most 'Views' (as determined and calculated by YouTube) as at the closing date will win the Grand Prize. |
| - The qualifying video that Marillion and/or their designated agents choose as their 'favourite' as at the closing date will win the Spot Prize. |
| - A single qualifying video is elligible to win both the Grand Prize and the Spot Prize |
| - A qualifying video must meet the following 4 requirements: |
| 1. The audio portion of the video must contain the full, unmodified audio file of Whatever is Wrong With You (Contest Edit) provided on this website (www.whateveriswrongwithyou.com). Editing, adding additional material, or overdubbing vocals, speech, or other audio into the video will disqualify the entry. |
| 2. The title of the uploaded video must be the full and complete text, "Marillion - Whatever is Wrong With You" Entries with other titles, or with additional names, text, numbers, or other information will disqualify the entry. |
| 3. Uploaded videos must contain the following Tags (added within the YouTube system): "Marillion", "Contest", "Music", and "Rock". Other additional tags may be added by the entrant. |
| 4. Submitted videos should avoid containing copyrighted or trademarked material, and must not contain offensive or illegal images. |
| - A non-exclusive synchronisation license for personal use only is granted by Marillion for the use of the track Whatever is Wrong With You (Contest Edit) in association only with the Marillion Whatever is Wrong With You Video Contest as detailed on this website. |
| - The copyright of all videos submitted to the Marillion Whatever is Wrong With You Video Contest will vest with Marillion |
| - The audio file provided on this website may not be re-distributed through any media by any means outside the terms and conditions of this contest without express written permission of Marillion/Racket Records. |
| - By submitting an entry, entrant is explicitly agreeing to the following media release for any individuals included in the submitted video: "I hereby give permission to Marillion / Intact Records / Racket Records to use the image provided, my name, likeness and biography for the purposes of Marillion / Intact Records / Racket Records promotional material and publications (including, but not limited to, television broadcast or synchronisation, website or other online or digital distribution, print
media) and waive any rights of compensation or ownership thereto in perpetuity. I warrant and represent that all material furnished by me is my own or for which I have full authority for such purposes." |
| - To upload a video to YouTube (www.youtube.com) entrants must create a user account with YouTube. Entrants are required to follow instructions and abide by all Terms of Use pursuant to creating a YouTube account in addition to the terms and conditions outlined on this website for the Marillion Whatever is Wrong With You Video Contest. |
| - Marillion/Racket Records has no affiliation with YouTube and cannot be held responsible for any actions that YouTube and its agents or appointed representatives may take in relation to any videos uploaded for the purposes of entry into this contest. |
| - Marillion/Racket Records will not be held responsible for any technical, software, accessibility, or compatibility issues that may arise with the use of this website (www.whateveriswrongwithyou.com), YouTube (www.youtube.com) or of the content provided thereon |
| - The Grand Prize provided with be the cash sum of 5000 British Pounds Sterling. |
| - The Spot Prize provided with be the cash sum of 5000 British Pounds Sterling. |
| - The Grand Prize and/or the will be paid by domestic or international electronic funds transfer only into a bank account to be designated by the contest winner. |
| - Marillion/Racket Records will not be responsible for any transfer fees, service charges, currency conversion commission, or any other fees associated with electronic funds transfer to the winner's account. As a consequence the sum paid to the winner may be less that 5000 British Pounds Sterling. |
| - A separate Spot Prize will be given to the qualifying video chosen collectively by Marillion and/or their designated agents to be the band's favourite. |
| - Marillion/Racket Records reserves the right to disqualify any video submitted that contains inappropriate imagery or themes, any content determined to be offensive, or any videos in violation of these terms and conditions or the Terms of Use of YouTube detailed on www.youtube.com |
| - Marillion/Racket Records' decision is final and no correspondence will be entered into. |
| - All winners will be contacted by the YouTube 'Send a Message' system with details of how to claim their prize. |
| - Marillion/Racket Records shall not be liable if, for any reason outside its control, any part of the chosen prize package becomes unavailable. |
| - Marillion/Racket Records takes no responsibility for incomplete, ineligible, or late orders/entries or any technical issues that arise with the YouTube website. |
| - If Marillion/Racket Records is unable to contact any winner within a period of 2 weeks following the closing date, having made reasonable efforts to do so, Marillion/Racket Records reserves the right in its absolute discretion to re-draw from the remaining eligible entries and select another winning participant. |
| - Marillion/Racket Records reserves the right to verify the validity of all entries. Marillion/Racket Records reserves the right to disqualify any entrant for tampering with the entry process or attempting to act in a fraudulent or otherwise dishonest manner. |
| - Marillion/Racket Records shall not be liable for any loss or damage suffered (including but not limited to indirect or consequential loss), or for any injury suffered or sustained or liability or costs incurred, as a result of accepting or using any prize, except for any liability that cannot be excluded by law. Marillion/Racket Records is not liable for any tax implications that may arise as a result of winning any prize. Prize values are given as at the commencement date of the promotions. |
| - Marillion/Racket Records reserves the right to substitute any of the prizes with that of similar value at any time without prior notice and all prizes are non transferable or exchangeable. |
| - Marillion/Racket Records will hold and may use personal information accompanying any entries for purposes relating to the promotion and for sending entrants promotional and other material in relation to future offers, information and activities of Marillion/Racket Records, unless otherwise advised by the entrant at the time of entry. |
| - Winners agree to be available for reasonable publicity purposes without compensation including, but not limited to, photographs and interviews. Copyright of such promotional material will vest in Marillion/Racket Records. Winners acknowledge that their personal details may be published in print media and on the internet. |
| - Marillion/Racket Records reserves the right modify these terms and conditions at any time without notice. |
